| Resumo: | O presente trabalho monográfico trata do tema “a adoção por casais homoafetivos frente ao princípio do melhor interesse do menor”. Pretende-se, à luz da literatura recente e relevante a propósito da situação em tela, analisar, discutir e apresentar os principais aspectos teóricos que envolvem essa problemática que objetiva investigar se a adoção por casais do mesmo sexo pode atentar contra o princípio do melhor interesse do menor. Para tanto, utiliza-se a metodologia hipotético-dedutiva e pesquisa bibliográfica que consiste, basicamente, na leitura, fichamento e comparação das teorias dos principais autores do Direito que tratam desse problema. Partindo-se do pressuposto de que todos são iguais perante a lei, sem distinção de sexo, cor ou mesmo orientação sexual, tendo por fundamento que, diante desta igualdade, o que se propõe é que o Estado inclua leis que beneficiem a todos e não somente a uma parte da sociedade, bem como considerando os principais aspectos atinentes à literatura em foco, “a adoção por casais homoafetivos frente ao princípio do melhor interesse do menor” é um tema que se apresenta como fundamental para todo e qualquer cidadão da modernidade, até porque atualmente existem diversos modelos de família em nossa sociedade, e, sem direitos, nenhum cidadão teria sua dignidade. Com isso, almeja-se que todo e qualquer indivíduo tenha o direito de adotar uma criança ou adolescente sem haver qualquer preconceito. |
| Resumo em outro idioma: | This monograph deals with "the adoption by homosexual couples against the principle of the best interests of the minor". It is intended, in the light of recent and relevant literature with regard to the situation in question, analyze, discuss and present the main theoretical aspect involving this issue which aims to investigate whether the adoption by same-sex couples may undermine the principle of the best interests of the minor. For this, we use the hypothetical-deductive methodology and literature research consisting basically in reading, book report and comparison of theories of the lead authors of the law that deal with this problem. Starting from the assumption that all are equal before the law, regardless of gender, color or even sexual orientation, taking on grounds that, in light of equality, what is proposed is that the state includes laws that benefit all and not just a part of society, and considering the main aspects related to the focused literature, "the adoption by homosexual couples against the principle of the best interests of the minor" is a theme that presents itself as fundamental to every citizen of modernity, especially because there are now many family models in our society, and with no rights, no citizen would have his dignity. With this, we aim that each and every individual has the right to adopt a child or adolescent without having any prejudice. |
