Umbanda : apontamentos sobre a interferência da religião no estado e o estudo da lei.

Abstract

This study has the general objective to verify how the constitutional right to religious freedom is used in our society, especially as the law is still influenced by religion. Present historical aspects of religious freedom in Brazilian Constitutions, as the consolidation of the secular state in the Federal Constitution of 1988. The points of discussion and controversy matters relating to law and religion. Religious bench in Congress and the influence on the decisions of the Supreme Court. The problem lies in the fact verify how religion influences right in Brazilian society. The relevance of this research is to know the extent to which this subject is treated and seen in society as well as the way it is working for the fundamental right to religious freedom is respected in fact. The methodology to be used in this work is the technical literature. Research will be carried out in law of articles, books and case law in all that manifest on the said topic. The method used in the research was the hermeneutic interpretation, allows a better interpretation of the law as part of a labor context, taking into account the law and positivism, always considering the historical and social aspects involved in its entirety. Faced with this, we intend to analyze the study as religion interferes in decisions of the Supreme Court and Congress.
