| Título: | Herança digital : um novo enfrentamento. |

| Resumo: | O presente trabalho monográfico trata do tema "herança digital" e como vem sendo enfrentado em razão da parca legislação acerca deste conceito. Tem-se, portanto, a seguinte problemática: Hodiernamente, o ordenamento jurídico brasileiro dá suporte ao Poder Judiciário para analisar as pretensões das partes que vivem numa era totalmente digital, cuja gera implicações diretas e indiretas em suas vidas, em especial a herança deixada nesse meio? Pretende-se, à luz da literatura recente e relevante a propósito da situação em tela, analisar, discutir e apresentar os principais aspectos teóricos que envolvem essa problemática. Para tanto, utiliza-se o método de abordagem hermenêutico, partindo do estudo das premissas conceituais e históricas do direito das sucessões, para chegar ao estudo de como a herança digital se enquadra neste ordenamento. Dado que a sucessão consiste basicamente numa continuidade dos direitos, deveres e obrigações do falecido, herança digital é um tema que se apresenta como fundamental para todo e qualquer cidadão da modernidade, até porque, a era digital está em foco, como se verá nos comentários da lei do marco civil, além disso, trata-se de uma ferramenta moderna desenvolvida pelo homem, que está em constante atualização, devendo ser estudado com o objetivo de aprimorar o Poder judiciário, que, inclusive, exige a informatização como pressuposto para a defesa de interesses. |
| Resumo em outro idioma: | The present monographic work deals with the theme "digital heritage”, and how it has been faced due to the scarce legislation about this concept. Therefore, the following problems are identified: Nowadays, the Brazilian legal system supports the Judiciary to analyze the claims of the parties living in a totally digital era, which generates direct and indirect implications in their lives, especially the inheritance left in this environment? It is intended, in the light of the recent and relevant literature on the situation on the screen, analyze, discuss and present the main theoretical aspects that envolve this problem. Therefore, the method of hermeneutical approach is used, starting from the study of the conceptual and historical assumptions of the law of succession, to arrive at the study of how the digital inheritance fits in this ordering. Assuming that the succession consists basically of a continuity of the rights, duties and obligations of the deceased, digital heritage is a theme that presents as fundamental to every citizen of modernity, even because, the digital age is in focus as will be seen in the comments of the law civil framework, besides that, it is a modern tool developed by man, which is constantly updated, it should be studied in order to improve the Judiciary, that, inclusively, requires computerization as a prerequisite for the defense of interests. |
