| Resumo: | O presente trabalho monográfico faz uma abordagem acerca da possibilidade e da necessidade de criação de um novo benefício previdenciário, o chamado "Auxílio-Doença Parental", frente à suposta crise na previdência social brasileira. Nesse sentido, pretende-se responder a seguinte problemática: diante do contexto atual de suposta crise no sistema da Seguridade Social e do embate "redução de direitos versus ampliação urgente da proteção social, mediante a criação de novos benefícios sociais", quais as consequências que a criação do novo benefício previdenciário - Auxílio-Doença Parental - traz à sociedade brasileira e como esta se dá frente ao contexto atual da Previdência Social? Para tanto, utiliza-se a metodologia dedutiva e como técnica de pesquisa a bibliográfica que consiste, basicamente, na pesquisa e interpretação doutrinária, visando uma análise geral da Seguridade Social, com foco na Previdência Social, bem como nas vantagens oriundas da criação de um novo benefício previdenciário na sociedade brasileira, frente à possibilidade orçamentária do sistema no financiamento deste. Partindo-se do pressuposto que a inclusão deste auxílio no atual rol dos benefícios garantidos aos contribuintes da Previdência Social, proporcionará uma melhora na qualidade de vida das pessoas que irão fazer jus a concessão deste, o presente trabalho descreve o sistema da Seguridade Social e discute a possibilidade da fonte de custeio preexistente para efetivar a sua criação no contexto atual da Seguridade Social brasileira. Além disso, demonstra a viabilidade jurídica e econômica da criação do Auxílio-Doença Parental e o risco social envolvido pela falta de regulamentação legal deste no Regimento Geral da Previdência Social. Após analisar a necessidade e a possibilidade da ampliação da proteção social, concluiu-se que há viabilidade jurídica e econômica para efetivar a criação do Auxílio-doença Parental, como forma de amenizar o prejuízo que referido desamparo social causa às famílias brasileiras. |
| Resumo em outro idioma: | The present monographic work approaches the possibility and the need to create a new social security benefit, the so-called "parental illness aid", in face of the alleged crisis in Brazilian social security. In this sense, it is intended to answer this: Given the current context of alleged crisis in the Social Security system and the struggle "reduction of rights versus urgent expansion of social protection, through the creation of new social benefits", what consequences the creation of the new social security benefit - Parental Aid - brings to the Brazilian society and how it is faced with the current context of Social Security? For that, it was used the deductive methodology was used and as a bibliographical research technique, which basically consists of research and doctrinal interpretation, aiming at a general analysis of Social Security, focusing on Social Security, as well as on the advantages derived from the creation of a new social security benefit in the Brazilian society, against the budgetary possibility of the system in the financing of this. Based on the assumption that the inclusion of this aid in the current list of benefits guaranteed to Social Security taxpayers, will provide an improvement in the quality of life of the people who will be entitled to the concession of this, this paper describes the Social Security system and discusses the possibility of the pre-existing source of funding to effect its creation in the current context of Brazilian Social Security. In addition, it demonstrates the legal and economic viability of the creation of the parental illness aid and the social risk involved by the lack of legal regulation of this in the social security system. After analyzing the need and the possibility of the expansion of social protection, it was concluded that there is legal and economic feasibility to effect the creation of this benefit, as a way to mitigate the loss that referred to social abandonment causes to Brazilian families. |
