Título: (Re)significando a lei de iniciativa popular enquanto instrumento das políticas públicas a partir da legitimidade democrática do direito social de Georges Gurvitch : participação cidadã e o aprimoramento da democracia local.

Resumo: O presente trabalho tem por tema a lei de iniciativa popular e o direito social de Georges Gurvitch. Pretende-se com o estudo abordar os desafios e as potencialidades da lei de iniciativa popular a partir de sua (re)significação amparada no direito social de Gurvitch. Muito embora a Constituição Federal de 1988 preveja o mecanismo de participação direta de propositiva legislativa, poucos são os casos de projetos de lei apresentados. Por esta razão questiona-se quais são as estratégias capazes de potencializar a lei de iniciativa popular no Brasil, como elemento de participação democrática na estrutura federativa - com ênfase esfera na municipal -, a partir dos pressupostos teóricos do direito social de Gurvitch?. Assim, o trabalho tem por objetivo investigar as estratégias capazes de potencializar a lei de iniciativa popular no Brasil, como elemento de participação democrática na estrutura federativa, com ênfase no nível municipal. Nesse intento, ampara-se no método de abordagem hipotético-dedutivo e pesquisa bibliográfica. Vinculada à área de concentração políticas públicas, a pesquisa tem por objetivo potencializar a lei de inciativa popular, pois com o deslocamento do cidadão para um papel de autor e co-responsável pela criação normativa, o processo político acaba sendo aprimorado, tornando a participação popular àquela capaz de fornecer complementaridade entre a atuação da democracia representativa e a participação direta da população nos assuntos públicos. A fim de responder ao questionamento proposto, são desenvolvidos cinco capítulos, e em cada um, tratadas questões relevantes para o tema. Inicialmente aborda-se as incoerências do sistema democrático, que nas sociedades modernas e diante da existência de diversos centos de poder, não consegue, muitas vezes, equacionar os diversos interesses envolvidos, priorizando alguns e condenando outros à miséria e a exploração, pois permite a transferência do critério material de decisão para estruturas de poder sem legitimidade política, onde muitas vezes os representantes não representam os interesses sociais para os quais foram eleitos. Portanto, busca-se expor as fragilidades e vulnerabilidades do sistema democrático, bem como da lei de iniciativa popular, que traz consigo além da possibilidade de contribuição direta de insumos à democracia, a potencial possibilidade de alteração da realidade social posta e a consequente mudança do status quo. Assim, diante de eventuais desafios e potencialidades, realiza-se a releitura e dá-se nova significação, a partir da legitimidade democrática do direito social de George Gurvitch, para construir uma política pública de participação cidadã que aprimore a democracia e que almeje os interesses públicos (sociais) da sociedade brasileira. É a partir do direito social de Gurvitch, construído socialmente, que se busca uma nova relação entre Estado e sociedade, dando-se ênfase na noção de democracia e participação popular. Em sede conclusiva, a utilização da ferramenta (re)significada permite a construção de novas normatividades, não produzidas somente pelo Estado, mas pela população, sendo reconhecidas por aquele, fortalecendo a cidadania democrático participativa. Conclui-se o estudo apontando-se para as principais alterações na lei de iniciativa popular, formais e materiais, que a aplicação da teoria causa na ferramenta participativa, com vistas a aperfeiçoar o mecanismo, bem como dar maior legitimidade ao processo legislativo.
Resumo em outro idioma: This paper aims the law of popular initiative and the Social Law of Georges Gurvitch. It intend to approach the challenges and potentialities of the law of popular initiative from its (re) meaning under the social law of Gurvitch. Although the Federal Constitution of 1988 provides for the direct participation mechanism of legislative proposals, there are few cases of bills submitted. For this reason it is questioned what are the strategies capable of strengthening the law of popular initiative in Brazil, as an element of democratic participation in the federative structure - with an emphasis in the municipal sphere -, based on the theoretical assumptions of Gurvitch's social law. Thus, the objective of this work is to investigate the strategies capable of strengthening the law of popular initiative in Brazil, as an element of democratic participation in the federative structure, with emphasis on the municipal level. In this attempt, it is based on the method of hypothetico-deductive approach and bibliographic research. Attached to the area of public policy concentration, research aims to strengthen the law of popular initiative, because with the displacement of the citizen to a role of author and co-responsible for normative creation, the political process ends up being improved, making popular participation to the one capable of providing complementarity between the performance of representative democracy and the direct participation of the population in public affairs. In order to respond to the proposed questioning, five chapters are developed, and in each one, issues that are relevant to the topic are addressed. Initially, it address the inconsistencies of the democratic system, which in modern societies and in the face of the existence of several hundreds of powers, often fails to equate the various interests involved, prioritizing some and condemning others to misery and exploitation. transfer of the material criterion of decision to structures of power without political legitimacy, where the representatives often do not represent the social interests for which they were elected. Therefore, it seeks to expose the fragilities and vulnerabilities of the democratic system, as well as the law of popular initiative, which brings with it the possibility of a direct contribution of inputs to democracy, the potential possibility of altering the social reality posta and the consequent change of the status quo.Thus, faced with possible challenges and potentialities, the re-reading is carried out and a new meaning is given, based on the democratic legitimacy of George Gurvitch's social law, to construct a public policy of citizen participation that enhances democracy and that seeks the interests (social) institutions of Brazilian society. It is from the social law of Gurvitch, socially constructed, that a new relationship between State and society is sought, with emphasis on the notion of democracy and popular participation. In conclusion, the use of the (re) signified tool allows the construction of new norms, not only produced by the State, but by the population, being recognized by it, strengthening participatory democratic citizenship. It concludes the study by pointing to the main changes in the law of popular initiative, both formal and material, that the application of the theory causes in the participatory tool, with a view to improving the mechanism, as well as giving greater legitimacy to the legislative process.
