Título: O direito da mulher de não ser mãe sob a perspectiva do parto anônimo.

Resumo: Atualmente são registrados um grande número de abandonos cruéis de recémnascidos, aborto e infanticídio. Essa realidade social não pode passar desapercebida pelo Estado, todavia é fato notório que a mulher sempre esteve em posição de desigualdade e mesmo com a igualdade de gêneros trazida pela Constituição Federal de 1988 a sociedade ainda não assimilou tais mudanças. Nessa perspectiva, estigmas sobre a maternidade continuam muito bem preservados, levando ao preconceito e discriminação de mulheres que não querem ser mães. O Parto Anônimo foi um projeto de lei que tinha por finalidade regulamentar no país a entrega de recém-nascidos e crianças como forma de substituição do abando, preservando a liberdade e intimidade da mulher, bem como determinando o acompanhamento psicológico e obstétrico da gestante, respeitando desde o início a escolha de entregar o menor. Assim, o presente trabalho de conclusão de curso tem por finalidade verificar a colisão de direitos fundamentais diante da possibilidade de instituir o parto anônimo no Brasil como forma de garantir o direito da mulher de não ser mãe. A partir de pesquisa legislativa, doutrinaria multidisciplinar, e também, reflexões bioéticas, buscar-se-á compreender os direitos fundamentais envolvidos. Por meio do método de abordagem indutivo e método procedimental hermenêutico-jurídico será analisado o fenômeno de colisão dos direitos fundamentais e formas de solução diante do caso concreto de conflito entre o direito de liberdade da mulher que não quer ser mãe e o direito à origem genética do filho, preservando seus núcleos essenciais, os quais correspondem a dignidade da pessoa humana. Tal estudo não é simples de solucionar, uma vez que existem diferentes formas de operar os princípios e de interpretar o ordenamento. Desta feita, fazendo uso do princípio da proporcionalidade é possível instituir o parto anônimo como forma de garantia de liberdade da mulher de não ser mãe, desde que preservado seu anonimato no momento da entrega. Todavia, para resguardar o núcleo axiológico do direito à origem genética, se faz necessário colher informações sobre aquele nascido do parto anônimo. Sempre haverá abandonos, sempre existirá traumas psicológicos, não importando as circunstancias, em que século ou o quanto a sociedade se modernize e evolua. No entanto, é possível, gradualmente, obter uma mudança social crescente no sentido de diminuir as tragédias vivenciadas e garantir proteção integral dos direitos fundamentais.
Resumo em outro idioma: A large number of cruel abandonment of newborns, abortion and infanticide are currently registered. This social reality can not go unnoticed by the State, however it is a notorious fact that women have always been in a position of inequality and even with the gender equality brought by the Brazilian Federal Constitution of 1988 society has not yet assimilated such changes. From this perspective, stigmas about motherhood are still very well preserved, leading to gender bias and discrimination against women who do not want to be mothers. The anonymous childbirth was a bill whose purpose was to regulate in the country the delivery of newborns and children as a way of replacing the abandonment, preserving the freedom and intimacy of the woman, as well as determining the psychological and obstetric follow-up of the pregnant woman, respecting from the beginning the choice to deliver the child. Therefore, the present work of graduation course, aims to verify the collision of fundamental rights before the possibility of instituting the anonymous birth in Brazil as a way to guarantee the right of the woman not to become mother. According to legislative research, multidisciplinary teaching, and also, bioethical reflections, seeks to understand the fundamental rights involved. Through the inductive method of approach and legal hermeneutic procedural method will be analyzed the phenomenon of collision of fundamental rights and ways of solution before the case of conflict between the right to freedom of woman who does not want to be a mother and the right to the genetic origin of the son, preserving its essential core, which correspond to the dignity of the human person. The study is not simple to solve, since there are different ways of operating principles and interpreting the legal order. This time, making use of the principle of proportionality, it is possible to institute anonymous childbirth as a way of guaranteeing women's freedom from not being a mother, provided that their anonymity is preserved at the time of delivery. However, in order to protect the axiological core of the right to genetic origin, it is necessary to gather information about the one born from the anonymous birth. There will always be abandonment, there will always be psychological traumas, no matter the circumstances, in what century or how modernize and evolve. However, it is possible to gradually achieve a growing social change in order to reduce the tragedies experienced and ensure full protection of fundamental rights.
