| Título: | A função de fiscalização do legislativo sobre a prestação de contas do executivo municipal : uma análise dos instrumentos utilizados para o controle externo a partir do estudo de caso em Sinimbu. |

| Resumo: | O atual quadro político brasileiro figura em um cenário desordenado e alicerçado em atos corruptos e indecorosos, não respeitando os princípios básicos de uma administração pública íntegra, sendo que o tema desta pesquisa se encontra intimamente relacionado a atual situação no País. Planeja-se com esse trabalho gerar uma perspectiva crítica quanto ao exercício de um dos três poderes que vigoram na ordem jurídica: o Poder Legislativo. Imprescindível, assim, à concretude da legalidade, a fiscalização do Legislativo no controle dos movimentos orçamentários e financeiros do Poder Executivo, restando clara a importância e influência da função fiscalizadora do Poder Legislativo sobre o Executivo no que diz respeitos aos atos praticados por tal poder. Desse modo o estudo tem como objetivo analisar a função de fiscalização do Poder Legislativo, no âmbito municipal, no que tange à prestação de contas do gestor administrativo anualmente. A partir disso a problemática de pesquisa baseia-se nas ferramentas empregadas para satisfazer o controle externo das movimentações financeiras realizadas pelo gestor municipal anualmente, compreendendo o período entre 2014 a 2017 e início de 2018, no município de Sinimbu - RS. Para responder a esse questionamento utilizou-se o método de abordagem hipotético dedutivo e de procedimento, o bibliográfico, com o manuseio de diversas obras pertinentes ao tema proposto, como doutrinas, normas jurídicas constitucionais e infraconstitucionais, dados da Prefeitura e Câmara de Vereadores do município de Sinimbu e artigos científicos para complementar o estudo e desenvolvimento do tema. Destarte, tendo como resultado a análise e a eficiência de todos os instrumentos fiscalizadores utilizados pela Câmara de Vereadores sobre os atos e prestações de contas do chefe do poder Executivo municipal. Conclui-se, assim, que as formas de controle utilizadas pelo Poder Legislativo objetivam manter a transparência e a integridade de uma gestão municipal, buscando assegurar os princípios da administração pública e os fundamentos democráticos, e, principalmente, a supremacia do interesse público. |
| Resumo em outro idioma: | The current Brazilian political figures in a cluttered scene and is anchored in corrupt and unseemly acts, not respecting the basic principles of public administration. The theme of this research is closely related to the current situation in the country and its purpose is to generate a critical perspective regarding the exercise of one of the three powers which prevail in our legal order: The Legislative Power. Indispensable for the concreteness of legality, the supervision of the legislature in the control of budgetary and financial movements of the Executive Power has the importance and influence of overseeing the legislative power over the executive in which affects acts practiced by such power. Therefore, this study aims to analyze the supervisory function of the legislative power in the municipal scope, in respect to the provision of administrative manager accounts annually. Based on this, the issue of the research is to examine which tools were used to meet the external control of financial operations carried out by the municipal manager annually, comprising the period between 2014 to 2017 and beginning of 2018, in the municipality of Sinimbu - RS. To answer this question, the method of hypothetical deductive approach and procedure was used, as well as bibliographic material with the handling of various works relevant to the theme proposed, such as doctrines, infra-constitutional legal standards, data from the City Hall and City Council from the municipality of Sinimbu and scientific articles to complement the study and development of the theme. With the result of the analysis and the efficiency of all instruments inspectors employed by the City Council about the benefits of acts and accounts of the head of the municipal executive power, it was concluded that the forms of control used by the Legislature aim to maintain the transparency and integrity of a municipal management, seeking to ensure the principles of public administration and the democratic foundations, and mainly, the supremacy of the public interest. |
