| Resumo: | O presente trabalho monográfico possui como objetivo analisar se a forma como a mídia transmite seus noticiários criminais afeta de alguma maneira às decisões proferidas pelos jurados. Nesse contexto, a problemática a ser enfrentada consiste em analisar se difusão das notícias pelos meios de comunicação se dá de forma clara e com respeito à veracidade ou se usam da linguagem sensacionalista na tentativa de formar opinião, comover o público e aumentar a audiência, quando enfatizam tal linguagem para transmitir seus noticiários criminais. A mídia atinge toda sociedade, direta ou indiretamente, inclusive os cidadãos que decidirão o futuro dos réus no tribunal do júri, ou seja, os jurados. Sendo assim qual a real influência que a mídia exerce nas decisões proferidas pelo tribunal popular? Para dar conta dessa tarefa, utiliza-se o método dedutivo contextualizando o problema de modo amplo com a finalidade de alcançar o específico. Será analisado o Tribunal do Júri e seus princípios, princípios constitucionais e do processo penal, a mídia e a relação com o processo penal brasileiro e sua influência no julgamento popular, alguns casos práticos e de grande repercussão na mídia brasileira, de forma que a resposta acerca da análise e da legislação em vigor seja alcançada. Quanto ao método de procedimentos, será feito pesquisa do tipo revisão bibliográfica e jurisprudencial. Muito embora a observação do objeto de análise proposta seja uma observação jurídica, em alguns momentos será necessário recorrer-se a diferentes enfoques como histórico, político, filosófico, dentre outros, para auxiliar na busca de sentido de algumas expressões, sem, contudo, perder o enfoque jurídico. No tocante às técnicas de pesquisa, elas estarão resumidas à pesquisa bibliográfica em diversas fontes. Essas, por sua vez, serão aproveitadas através de metodologia de procedimento de leitura, exame de jurisprudência e fichamentos. Por fim, pode-se incialmente, afirmar que a mídia sendo a grande e principal formadora de opinião pública, e que isso se espelha diretamente no processo penal, é de suma importância que os princípios constitucionais que norteiam nosso universo jurídico sejam completamente respeitados, para que exista de fato um estado de direito mais justo. |
| Resumo em outro idioma: | The present monographic work aims to analyze if the way the media transmits their criminal news reports affects in some way the decisions pronounced by the jurors. In this context, the problem to be faced is to analyze whether the dissemination of news by the media is clear and with respect to veracity or if they use sensationalist language in an attempt to form an opinion, move the audience and increase the audience, when emphasize such language to broadcast their criminal news. The media affects every society, directly or indirectly, including citizens who will decide the future of the defendants in the jury court, that is, jurors. So what is the real influence that the media has on the decisions handed down by the people's court? To account for this task, the deductive method is used by contextualizing the problem broadly in order to achieve the specific. The Jury Tribunal and its principles, constitutional principles and criminal procedure, the media and the relationship with the Brazilian criminal process and its influence in the popular judgment, some practical cases and of great repercussion in the Brazilian media will be analyzed, so that the answer the analysis and legislation in force is achieved. As for the method of procedures, will be done research of the type bibliographical revision and jurisprudential. Although the observation of the proposed object of analysis is a legal observation, in some moments it will be necessary to resort to different approaches such as historical, political, philosophical, among others, to help in the search for meaning of some expressions, without, however, losing the legal approach. With regard to research techniques, they will be summarized in bibliographical research from several sources. These, in turn, will be utilized through methodology of reading procedure, examination of case law and records. Finally, it can be stated at the outset that the media being the great and main public opinion-maker, and that this is directly reflected in the criminal process, it is of the utmost importance that the constitutional principles guiding our legal universe be fully respected, that there is in fact a more just state of law. |
