Estudo comparado das regras da aposentadoria rural por Idade face ao projeto de reforma da previdência : análise das consequências aos segurados especiais.

Abstract

This monographic work will address the main changes that the pension reform project would bring to rural retirement by age, analyzing the consequences of this benefit, this way it aims to carry out a comparative study of the current legislation and the Pension Reform Project with respect to the special insured, mainly to their right to retirement by age and to analyze the reflexes that this change would cause in the rural environment. In this context, the problems to be faced consists of knowing the consequences of the changes of the Welfare Reform Project for small rural workers? In order to deal with this task, the deductive method is used. The choice of this theme is justified for being one of the most controversial subjects today and verifying the reflexes of these changes in rural retirement brought by a pension reform it becomes important to find out how the legal order and society can be affected. For this in the first chapter will be traced a history of Social Security and Rural Pensions in Brazil, in the second chapter, a study will be made of the current rules of rural retirement provided for in legislation and the third chapter will analyze the rules proposed in the texts of the Draft Constitutional Amendment 287 and the consequences that these changes would cause in the rural environment. It can be initially stated that the main changes that would cause more impact to the rural worker regarding retirement by age, faced with a possible pension reform would be the change in the age of the worker to retire, the implementation of a monthly contribution system, which would make it difficult for them to survive in the field. These changes would not bring any benefit to the rural worker, on the contrary would only bring problems to plead his retirement and as a consequence of this, consequences such as the difficulty of paying the contribution and exclusion from the category of social protection, the rural exodus, and the weakening of the figure of women in rural areas.
