| Resumo: | A realidade de alguns jovens brasileiros segue caminhos difíceis que os levam ao cometimento de delitos e assim, ao invés de cumprirem pena no cárcere - como os adultos - são encaminhados para um instituto de ressocialização juvenil. Atualmente, são altos os índices apresentados nos jornais relacionados à atos infracionais praticados por menores de idade, e muitas vezes, os autores são adolescentes reincidentes. Considerando tal situação, o objeto do presente trabalho é tratar sobre determinada fundação destinada a ressocialização de jovens infratores, no qual localiza-se em Porto Alegre, no estado do Rio Grande do Sul. A instituição para adolescentes infratores mostra-se tão importante, no momento em que se verifica que crianças e adolescentes possuem proteção integral oriunda da Constituição Federal. Porém, ao mesmo tempo em que o Estado tem a responsabilidade em promover o bem-estar do jovem infrator, possui o compromisso com a população vista como um todo, no momento em que há determinação constitucional e fundamental referente a segurança. Por esse motivo, os jovens infratores deverão ter sua liberdade restringida, de modo disciplinar quando cometem ato infracional considerado de grande potencial ofensivo. Sendo assim, o problema central deste trabalho monográfico é verificar se a FASE/RS cumpre com o seu objetivo de ressocialização dos adolescentes infratores, demonstrando o funcionamento interno da instituição com as políticas utilizadas para a concretização do fim, bem como, analisa números reais sobre a entrada e saída dos jovens infratores na instituição da FASE/RS, buscando aferir a eficácia do sistema em si a partir do critério reincidências, ou seja, do retorno do infrator à vida delitiva após a primeira internação. Para tanto, utilizou-se dos métodos histórico e quantitativo para ao final verificar que o número de jovens reingressos na instituição analisada é, em média 40% do número dos primeiros ingressantes e por isso, não se pode dizer que é uma instituição que cumpre o seu principal objetivo. |
| Resumo em outro idioma: | The reality of some young Brazilians follows difficult paths that lead them to commit crimes and thus, instead of serving time in jail - like adults - are sent to a juvenile re-socialization institute. Currently, the indexes presented in the newspapers related to the infractions committed by minors are high, and the authors are often repeat offenders. Considering this situation, the present study aims to study the foundation for the resocialization of young offenders located in Porto Alegre, Rio Grande do Sul State. The institution for juvenile offenders is of great importance in guaranteeing the comprehensive protection advocated by the Federal Constitution. However, at the same time that the State has the responsibility to promote the welfare of the young offender, it is committed to the safety of the population in general. For this reason, young offenders should have their freedom restricted in order to discipline them when they commit an infraction of high offensive potential. Therefore, the central problem of this monographic work is to verify if FASE / RS fulfills its objective of resocialization of the juvenile offenders. To do so, it demonstrates the internal functioning of the institution and the policies used to achieve the goal, as well as analyzes real numbers on the entry and exit of young offenders seeking to assess the effectiveness of the system itself from the criterion of recidivism, in other words, of the return of the offender to the delinquent life after the first intern. For that, historical and quantitative methods were used to finally verify that the number of young re-entries in the analyzed institution is, on average, 40% of the number of the first entrants and therefore, it can not be said that it is an institution that fulfills its main objective of resocialize the adolescent offender. |
