Título: A (i)legitimidade constitucional do Tribunal do Júri no ordenamento jurídico brasileiro.

Resumo: O objetivo do presente trabalho é analisar o Tribunal do Júri à luz da Constituição da República Federativa do Brasil, e a possível existência de legitimidade do procedimento penal. O trabalho visa analisar a origem do Tribunal do Júri, tanto no ordenamento jurídico brasileiro, como em sua ideia original em países estrangeiros; apontar o conceito de Tribunal do júri; analisar a aplicação do Tribunal do Júri no processo penal brasileiro; discutir a justificativa da utilização do Tribunal do Júri no Brasil; debater a questão social em relação ao júri e o acusado; comparar argumentos favoráveis e contrários ao Tribunal do Júri. Busca-se responder à seguinte pergunta: é legítima a aplicação do tribunal do júri no processo penal brasileiro, como fator garantidor do devido processo legal, baseando-se em um sistema jurídico diferente do utilizado no Brasil? Com a predominância do método indutivo para analisar casos em processos que utilizam do Tribunal do Júri e opiniões de autores que expressam seu posicionamento contrário ou favorável ao instituto; uso do método dialético para contraposição de ideias, no que diz respeito às justificativas para a existência do Tribunal do júri. Foram utilizados também os métodos histórico e comparativo para analisar os fatores históricos e de origem do Tribunal do Júri, tanto no brasil como no exterior; predominância do método sociológico, utilizando também o exegético para a análise da questão social e democrática que envolve o Tribunal do júri; pesquisa bibliográfica, documental, descritiva e qualitativa, para formar ideias e obter opiniões e jurisprudência que tratam do tribunal do Júri. Com a presente análise é possível entender como funciona o procedimento do júri e quais os princípios que o regem, assim como entender quais direitos procuram-se defender através da aplicação do procedimento. Também foram analisadas opiniões divergentes acerca do tópico, que mostram-se fortes ao defender principalmente os direitos e garantias fundamentais.
Resumo em outro idioma: The objective of this study is to analyze the Trial by Jury according to the Constitution of the Federative Republic of Brazil, and the possible existence of legitimacy of this criminal procedure. The study aims to analyze the origins of the Trial by Jury, both in Brazilian legal order, and in its original idea in foreign countries; point the concept of the Trial by Jury; analyze the application of the Trial by Jury in Brazilian criminal procedure; discuss the justification of using the Trial by Jury in Brazil; discuss the social matter related to the Jury and the defendant; to compare favorable and contrary arguments to the Trial by Jury. The study seeks to answer the following question: is it legitimate to apply the Trial by jury in the Brazilian criminal procedure, as an assurance factor of applying the due process of law, based in a legal system that is different from the one used in Brazil? With predominance of the inductive method for analyzing cases in processes that use the Trial by Jury, and opinions from the authors who express their position, both favorable and contrary to the institution; using the dialethic method for countering ideas, in reference for the reasons of the existence of the Trial by Jury. Were used, as well, the historic and comparative methods for analyzing the historic and origin factors of the Trial by Jury, both in Brazil and abroad; predominance to the sociological method, as well using the exegesis for analyzing the democratic and sociological matters that implicate in the Trial by Jury; descriptive and qualitative bibliographic and documental research to form ideas and obtain opinions and jurisprudence about the Trial by Jury. With the present study is possible to understand how the Jury procedure Works, as well as the principles that rule it and to understand the rights willing to be defended with the procedure appliance. Were too analyzed dissonant opinions on the matter, revealing to be strong when defending, mainly the fundamental rights and guarantees.
