| Resumo: | A dissertação analisa a estruturação das políticas públicas de acolhimento familiar, tendo como referência exemplo o município de Santo Ângelo. Nele abordam-se os direitos das crianças e adolescentes, no marco da teoria da proteção integral, o direito à convivência familiar e comunitária, a prioridade absoluta para crianças e adolescentes, e as espécies de colocação em família substituta. Também se verificam a estruturação das políticas públicas de acolhimento institucional em suas diversas possibilidades, vislumbrando brevemente a figura do apadrinhamento afetivo, que aos tipos de acolhimento pode servir de apêndice. Especificamente se verificam as legislações, municipal de Santo Ângelo e estadual do Rio Grande do Sul, o Sistema Único de Assistência Social, o Plano Nacional de Promoção, Proteção e Defesa do Direito de Crianças e Adolescentes à Convivência Familiar e Comunitária e a realidade das crianças e adolescentes do município de Santo Ângelo, que faz justificar a necessidade dos serviços de acolhimento. A dissertação teve como problema de pesquisa verificar quais as estratégias e como se desenvolveu a política pública de acolhimento familiar em Santo Ângelo pena análise da legislação elaborada no município. Como hipótese que o acolhimento familiar atende o disposto na legislação, garantindo a proteção integral de crianças e adolescentes enquanto acolhidos com famílias substitutas. O objetivo geral de estudar as políticas públicas de acolhimento familiar no município se coaduna com os objetivos específicos de sistematizar os fundamentos jurídicos dos direitos à convivência familiar e comunitária de crianças e adolescentes, considerando a regulamentação jurídica, bem como de analisar as políticas públicas de acolhimento no contexto das estratégias de estruturação do Sistema Único de Assistência Social e a específica aplicação do Programa Família Acolhedora no município de Santo Ângelo e sua recepção legislativa, inicialmente municipal e posteriormente estadual. Para o desenvolvimento do trabalho foi utilizado o método de abordagem dialético, que estuda de maneira interdisciplinar, os fenômenos políticos, sociais, culturais e econômicos do município e das formas de acolhimento. O método de procedimento é monográfico, com técnicas de pesquisa indireta por meio do uso de ferramentas bibliográfica e documental. A dissertação está vinculada à linha de Políticas Públicas de Inclusão Social do Programa de Pós-Graduação - Mestrado e Doutorado em Direito da Universidade de Santa Cruz do Sul - UNISC e a linha específica de estudo dos Direitos Humanos de Crianças, Adolescentes e Jovens. Conclui-se que foram verificadas as estratégias de articulação intersetorial, a obediência ao comando legislativo e que, embora os fatores diversos da vida possam direcionar as crianças e adolescentes para situações de violação de direitos, o serviço de acolhimento familiar, denominado Programa Família Acolhedora, agora de abrangência estadual, é maneira efetiva de sanar, ainda que temporariamente, as violações de direitos, até que sejam sanados os motivos que levaram a colocação em família substituta ou se verifique a necessidade de colocação em família substituta. Há sim, no acolhimento familiar, a verificação e a preocupação com o marco da teoria da proteção integral, com o Estatuto da Criança e do Adolescente, com o Direito Socioassistencial e com o Direito da Criança e do Adolescente em geral, bem como com as pessoas em condição peculiar de desenvolvimento, que são as crianças e adolescentes, objetivo e fim específico deste trabalho. |
| Resumo em outro idioma: | The paper analyzes the structuring of public policies of family hosting, having as an example the city of Santo Ângelo. It addresses the rights of children and adolescents within the framework of integral protection theory, the right to family and community living, the absolute priority for children and adolescents, and the species of placing in substitute families. It also verifies the structuring of public policies of institutional hosting in its various possibilities, glimpsing briefly the figure of the affective sponsorship, that to the types of hosting can serve as an appendix. Specifically are verified the legislations, municipal in Santo Ângelo, and of the state of Rio Grande do Sul, the Unified System of Social Assistance, the National Plan to the Promotion, Protection and Defense of de Rights of Children and Adolescents to Family and Community Living and the reality of children and adolescents of the city of Santo Ângelo, that makes justify the need to the services of hosting. The dissertation had, as research problem, to verify the strategies and how it was developed the public policy of family family hosting in Santo Ângelo through the analysis of the legislation created in that city. As hypothesis, that the family hosting complies with the provisions of the legislation, guaranteeing the integral protection of children and adolescents while being fostered with hosting families. The main objective of studying the public policies of family hosting in the city is in line with the specific objectives of systematize the legal grounds in the rights of family and community living of children and adolescents, considering the legal regulation, as well as to analyze the public policies of hosting in the context of the strategies of structuring of the Unified System of Social Assistance and the specific appliance of the program Família Acolhedora in the city of Santo Ângelo and its legislative reception, initially municipal and posteriorly in the State. To the development of the paper the deductive method of approach was used, that studies, in an interdisciplinary way, the political, social, cultural and economic phenomena of the municipality and the forms of hosting. The monographic method of procedure was used, alongside with the indirect research, by using bibliographical and documental tools. The dissertation is linked to the line of research of Public Policies of Social Inclusion from the Program of Postgraduate studies – Masters and Doctorate in Law of the University of Santa Cruz do Sul – UNISC and the specific line of studies of Human Rights of Children, Adolescents and Youth. It concludes that were verified the strategies of intersectorial articulation, the obedience to the legislation and that, although the various factors of life may direct the children and adolescents to situations in what they’re rights are violated, the family hosting service, denominated Programa Família Acolhedora, now in state scope, is an effective way to heal, even temporarily, the violations of rights, until the families are re-educated, or it is verified the need of substitute family placement. There is, in family hosting, the verification and the concern with the mark of the integral protection theory, with the Statute of Children and Adolescents, with the Socioassistencial Rights and with the Right of Children and Adolescent in general, as well with the people in peculiar condition of development, that are the children and adolescents, objective and specific purpose of this paper. |
