Título: Possibilidades constitucionais para a vinculação da aplicação da sobra de duodécimo nas câmaras municipais : uma leitura a partir da democracia participativa.

Resumo: O Poder Executivo tem a obrigação constitucional de repassar mensalmente os valores necessários para o funcionamento da Câmara Municipal, observando-se os limites estabelecidos na legislação, havendo economia, a sobra do duodécimo é obrigatoriamente devolvida ao Executivo. Construir mecanismos constitucionais que possibilitem e embasem ao Poder Legislativo Municipal vincular a aplicação das sobras de duodécimo ao Executivo a partir de uma perspectiva de Democracia Participativa é o tema proposto nessa dissertação, delimitada ao âmbito do ordenamento jurídico-político brasileiro e dentro da Filosofia Política, Direito Constitucional e Direito Administrativo. A questão proposta é: haveria no ordenamento jurídico amparo constitucional para embasar e viabilizar um projeto de lei de iniciativa popular ou projeto de lei de iniciativa da Câmara, promulgados através de decreto-legislativo municipal, que possibilite ao Poder Legislativo Municipal vincular a aplicação das sobras de duodécimo ao Executivo a partir de uma perspectiva de Democracia Participativa? Partindo-se da hipótese de que é necessário perquirir a possibilidade da aplicação dessa verba, questionam-se os meios legais de fundamentar um decreto-legislativo para tal fim, seja através de projeto de lei de iniciativa popular ou projeto de lei de iniciativa da Câmara Municipal. Sendo assim, tem-se como objetivo geral: investigar o decreto legislativo municipal como mecanismo jurídico-político constitucional adequado para estabelecer a vinculação da aplicação da sobra de duodécimo a uma política pública do Poder Executivo ou do próprio Poder Legislativo e especificamente: descrever a separação de poderes municipais e sua relação com a Democracia Participativa, analisar os conflitos decorrentes da aplicação do duodécimo e construir um regime jurídico participativo para a aplicação da sobra do duodécimo. Essa pesquisa se justifica pelo fato de que não se tem notícia no ordenamento jurídico pátrio, de um trabalho acadêmico semelhante e pela importância de se estabelecer mecanismos vinculativos da aplicação da sobra do duodécimo ao Poder Executivo ou do próprio Poder Legislativo. Para esse fim, buscou-se na metodologia da pesquisa com objetivo exploratório, documental, através do método hipotético-dedutivo e abordagem qualitativa, os procedimentos necessários para a sua concretização. A coleta de dados restringiu-se ao ordenamento jurídico-político brasileiro, virtual e impresso e por fim, concluiu-se que, haja vista a natureza jurídica do orçamento público (lei formal), sendo o duodécimo um montante enviado à Câmara, decorrente do orçamento público e que, a partir de então, faz parte de valores que pertencem à Câmara. De outro lado, tendo em vista que o duodécimo não é revestido somente de receitas tributárias, data vênia, não haveria infringência ao art. 167, IV, da Constituição Federal, que proíbe a vinculação na arrecadação de impostos. Portanto, a possibilidade de vincular a aplicação da sobra do duodécimo, através de decreto-legislativo seria legítima.
Resumo em outro idioma: The Executive Branch has the constitutional obligation to pass on monthly amounts necessary for the functioning of the City Council, observing the limits established in the legislation, there being economy, the remainder of the twelfth is mandatorily returned to the Executive. Constructing constitutional mechanisms that enable and support the Municipal Legislative Power to link the application of the twelfth to the Executive from a perspective of Participative Democracy is the theme proposed in this dissertation, delimited within the scope of the Brazilian legal-political order and within the Political Philosophy, Constitutional Law and Administrative Law. The proposed question is: would there be in the legal system constitutional amparo to support and make feasible a bill of initiative or initiative bill of the House, promulgated through a municipal legislative decree, which allows the Municipal Legislative Branch to link the application of leftovers from the twelfth to the Executive from a perspective of Participatory Democracy? Starting from the hypothesis that it is necessary to investigate the possibility of the application of this amount, the legal means to base a legislative decree for this purpose are questioned, either through a popular initiative bill or a bill of initiative of the Chamber Municipal. Thus, it is a general objective: to investigate the municipal legislative decree as an appropriate constitutional legal-political mechanism to establish the linkage of the application of the twelfth to a public policy of the Executive Branch or of the Legislative Branch itself and specifically: describe the separation of municipal powers and their relationship with Participative Democracy, to analyze the conflicts arising from the application of the twelfth and to construct a participatory legal regime for the application of the surplus of the twelfth. This research is justified by the fact that there is no news in the legal order of the country, a similar academic work and the importance of establishing binding mechanisms for applying the surplus of the twelfth to the Executive Branch or the Legislative Branch itself. To this end, we sought the research methodology with an exploratory, documentary objective, through the hypothetical-deductive method and qualitative approach, the necessary procedures for its realization. The collection of data was restricted to the Brazilian legal and political order, virtual and printed, and finally, it was concluded that, given the legal nature of the public budget (formal law), the twelfth is an amount sent to the House, as a result of public budget and that, from then on, is part of values that belong to the Chamber. On the other hand, given that the twelfth is not only covered by tax revenues, date comes, there would be no violation of art. 167, IV, of the Federal Constitution, which prohibits tying in the collection of taxes. Therefore, the possibility of linking the application of the surplus of the twelfth, through legislative decree would be legitimate.
