Políticas públicas para inserção da mulher imigrante no mercado de trabalho decente : uma análise com base na Lei nº 13.445/2017 e na realidade existente no município de Porto Alegre/RS.

Abstract

The subject of this dissertation is about public policies and the insertion of immigrant women into the job market in the municipality of Porto Alegre from the period of January of 2010 to November of 2018. Therefore, showing the following research problems: what are the existing public policies in the municipality of Porto Alegre based on law 13.445/2017 (Law of Migration), which aim at the insertion of immigrant women into the job market and, consequently, their social inclusion? To answer this question, it is based on a negative hypothesis, taking into account that despite the importance of labor activity as a means of social inclusion, the recent legislative amendment has not yet had practical effects in the local government, since the municipality lacks public policies aimed at the insertion of immigrant women in the labour market. In this sense, the main objective lies in checking for the existence of effective public policies within the municipality of Porto Alegre/RS, which in turn aim at inserting immigrant women into the job market and, consequently, their social inclusion, based on the law nº 13.445/2017. The specific objectives are related to each of the three chapters: in the first, the intent is to understand the performance of the international system of protection of human rights in guaranteeing the rights of immigrant women, addressing the protection of the human being in general in the context of migration, with attention laid on gender sensitive solutions. In the second, the system of protection and promotion of immigrant employment from the perspective and concept of decent work will be analysed. Therefore, emphasis is placed on the regulation of women's work in Brazil, based on labour rights as a means of valuing social inclusion of the same. In the third, an attempt to ascertain the existence of public policies within the city of Porto Alegre (based on the immigration law) aimed at labour inclusion of women, the analysis of statistic data related to the feminine labour market, attained through the analysis and interviews carried out with public institutions and segments of the civil society which advocate and welcome the immigrants, as well as women immigrants settled in Porto Alegre, and emphasising the need for the implementation of public policies. As a method of approach, the deductive was used. The research techniques used were, bibliographic, documental and field work. It is concluded that the city of Porto Alegre does not yet have public policies focused on the labor inclusion of immigrant women. The service of welcoming and promoting actions aimed at inserting immigrants into local society depends predominantly on the action of civil society, although local power is engaged in this issue through COMIRAT POA, whose own creation can be cited as a public policy aimed at people mobility in general.
