| Resumo: | A migração é um fenômeno antigo, ocorrendo com intensidade e frequência variadas ao longo da história e a imigração venezuelana para a cidade de Boa Vista, vem ocorrendo devido ao país vizinho estar enfrentando uma crise humanitária sem precedentes desde 2014 atribuída a fatores como o modelo de governo adotado no país. Diante desse contexto, a pesquisa tem como tema a garantia dos Direitos Fundamentais dos imigrantes venezuelanos em Roraima à luz das Políticas Públicas Sociais, sendo seu objetivo geral analisar se os direitos fundamentais previstos na Constituição Federal de 1988 são garantidos aos imigrantes venezuelanos no plano urbano do município de Boa Vista (Roraima), tomando como referência as políticas públicas sociais produzidas tanto pelos entes governamentais como pela sociedade civil. A pesquisa é realizada a partir da seguinte problematização: Os direitos fundamentais sociais previstos na Constituição Federal de 1988 estão sendo garantidos aos imigrantes venezuelanos por meio de políticas públicas na cidade de Boa Vista - Roraima? Como hipóteses ao referido problema temos uma negativa onde se observa que existe um baixo grau de efetividade em relação aos direitos fundamentais sociais e uma assimetria entre elas, pois nem o Estado, nem a sociedade civil têm conseguido garantir aos imigrantes venezuelanos os direitos previstos na Carta Magna e outra positiva, a qual afirma que apesar de todas as dificuldades que o Estado vem enfrentando, juntamente com órgãos públicos e a sociedade civil, têm conseguido realizar um bom trabalho e garantir aos imigrantes venezuelanos os direitos fundamentais sociais previstos na Constituição Federal. De forma especifica objetiva-se analisar a temática migratória e desenvolver uma revisão na literatura doutrinária sobre a temática da migração; estudar a imigração no Brasil e as Políticas Públicas Sociais realizadas e por fim, analisar a efetividade das políticas públicas sociais e a garantia do direito fundamental aos imigrantes venezuelanos no município de Boa Vista - Roraima. Este estudo foi orientado pelo Professor Doutor Clóvis Gorczevski e está diretamente ligado as pesquisas desenvolvidas na linha de constitucionalismo contemporâneo do Programa de Pós-Graduação em Direito, Mestrado e Doutorado na Universidade de Santa Cruz do Sul. A metodologia utilizada se faz por meio do método de abordagem o histórico-dedutivo, procedimentos de revisão bibliográfica, documental e coleta de dados. Dito isso, chega-se à conclusão da importância da adoção de políticas públicas específicas para abrigar e atender as necessidades dessas pessoas em condição de vulnerabilidade, a qual deve estar baseada no respeito à dignidade humana, princípio adotado pela Constituição brasileira e oferte melhores condições de vida em um sentido amplo, onde possa ser conferido o livre exercício da participação ativa na vida pública, onde o imigrante tenha voz e seus direitos protegidos. Em Boa Vista essas ações estão sendo feitas pelas instituições governamentais e pela sociedade civil que não estão medindo esforços para garantir aos imigrantes venezuelanos seus direitos fundamentais previstos na Constituição Federal de 1988. |
| Resumo em outro idioma: | Migration is an old phenomenon, occurring with varying intensity and frequency throughout history and Venezuelan immigration to the city of Boa Vista, has been occurring because the neighboring country is facing an unprecedented humanitarian crisis since 2014 attributed to factors such as the model of adopted in the country. Given this context, the research has as its theme the guarantee of the Fundamental Rights of Venezuelan immigrants in Roraima in the light of Social Public Policies, and its general objective is to analyze whether the fundamental rights provided for in the Federal Constitution of 1988 are guaranteed to Venezuelan immigrants in the in the city of Boa Vista (Roraima), taking as reference the public social policies produced by both governmental entities and civil society. The research is carried out from the following problematization: Are the fundamental social rights foreseen in the Federal Constitution of 1988 being guaranteed to the Venezuelan immigrants through public policies in the city of Boa Vista -Roraima? As a hypothesis to this problem we have a negative where it is observed that there is a low degree of effectiveness in relation to fundamental social rights and an asymmetry between them, since neither the State nor civil societyhave been able to guarantee the Venezuelan immigrants the rights foreseen in the Magna Carta and other positive, which states that despite all the difficulties that the State has been facing along with public agencies and civil society, they have managed to do a good job and guarantee Venezuelan immigrants fundamental social rights provided for in the Federal Constitution. Specifically, it aims to analyze the migratory issue and to develop a review in the doctrinal literature on migration issues; to study immigration in Brazil and the Social Public Policies carried out; and finally, to analyze the effectiveness of public social policies and the guarantee of the fundamental right to Venezuelan immigrants in the municipality of Boa Vista -Roraima. This studywas directed by Professor Clóvis Gorczevski and is directly linked to the research developed in the line of contemporary constitutionalism of the Postgraduate Program in Law, Master's and Doctorate at the University of Santa Cruz do Sul. The methodology used is based on the method of historical-deductive approach, procedures for bibliographical revision, documentary and data collection. Having said that, it is concluded the importance of adopting specific public policies to shelter and meet the needs of these vulnerable people, which must be based on respect for human dignity, a principle adopted by the Brazilian Constitution and offer better living conditions in a broad sense, where the free exercise of active participation in public life can be conferred,where the immigrant has a voice and his rights protected. In Boa Vista these actions are being carried out by government institutions and civil society that are not making efforts to guarantee to Venezuelan immigrants their fundamental rights foreseen in the Federal Constitution of 1988. |
