| Resumo: | O presente trabalho visa analisar os direitos dos idosos em situação de abandono em Instituições de Longa Permanência para Idosos - ILPI e quem é responsável pela defesa destes. Nestes termos, indaga-se a respeito dos deveres jurídicos impostos às Instituições de Longa Permanência para Idosos e quem é responsável por garanti-los, uma vez que o crescimento acelerado da população de idosos evidencia o aumento dos casos de abandono. Desta forma, importante entender quais os direitos do idosos institucionalizados, a fim de buscar a proteção do idoso em situação de abandono familiar e social. Objetivou-se identificar a tutela jurídica dos direitos garantidos aos idosos, as formas de abandono de idosos, quais sejam, material e afetivo ou imaterial, bem como qual a responsabilidade da família, sociedade e do Estado em relação ao abandono de idosos em ILPI. O método de abordagem utilizado é o dedutivo, partindo-se do estudo de literatura especializada, revistas, artigos científicos e periódicos. É de fundamental importância o estudo do tema, visto que o abandono de idosos, tanto material, quando afetivo ou imaterial, em Instituições de Longa Permanência de Idosos, esta cada vez mais presente na sociedade brasileira, de modo que causa efeito nas relação jurídicas de âmbito familial e social. |
| Resumo em outro idioma: | The present work aims to analyze the rights of the elderly in situations of abandonment in Long-Term Institutions for the Elderly and who is responsible for their defense. In these terms, we inquire about the legal duties imposed on LongTerm Institutions for the Elderly and who is responsible for ensuring them, since the accelerated growth of the elderly population evidences the increase in cases of abandonment. Thus, it's important to understand the rights of the institutionalized elderly, in order to seek the protection of the elderly in situations of family and social abandonment. The objective was to identify the legal protection of the rights guaranteed to the elderly, the forms of abandonment of the elderly, that is, material and affective or immaterial, as well as the responsibility of the family, society and the State in relation to the abandonment of the elderly in Long-Term Institutions for the Elderly. The method of approach used is the deductive one, starting from the study of specialized literature, magazines, scientific articles and periodicals. It is of fundamental importance to study the theme, since the abandonment of the elderly, both material, affective and immaterial, in Long-Term Institutions for the Elderly, is increasingly present in Brazilian society, so that it has an effect on the legal relationships of family and social environment. |
