Abstract

Analysis of the current social condition, inequality and fundamental guarantees guaranteed, in particular, by the Federal Constitution, addressing the high level of unemployed, as well as the probable loss of millions of jobs in the future, especially due to the technology that tends to gradually introducing artificial intelligence in most areas, thus replacing the work developed by human beings. From these premises, we ask: “the dignity of the human person, raised to the category of fundamental right, guaranteed by the Constitution, can support the introduction of a social policy that offers basic income to all Brazilians? Is there a duty for the legislator? What are the impacts on social rights? “. In view of this, the objective of the work is to seek answers and these questions and demonstrate that given the prediction of an increase in social inequality and a decrease in job vacancies, it is necessary for the State to contain through effective public policies the harms that can come from this reality, as well as from the disadvantages that millions of people are subjected by the lack of opportunities and their social context. Thus, the possibilities of implementing a basic income will be analyzed, under a constitutional approach, in particular the fundamental rights guaranteed in the Federal Constitution of 1988. At the end, the proposal for a basic income is presented as a solution to the existing and new challenges that will come in relation to the income of millions of people, being an instrument to guarantee a livelihood and a dignified life for all citizens.
