dc.description.abstractIn this paper we analyze the fulfillment of the social function of property in small cities of the Vale do Rio Pardo Region, more specifically, the case of the city of Sobradinho - RS. The theme of the social function of urban property and its fulfillment, as well as the need to establish a greater regulation and inspection by the municipal public power, has been more widely analyzed in the context of large and medium-sized cities, where the dynamics of urbanization has been more intense. In small cities, this theme has been little analyzed and debated in the country. In these cities, the property owner is often, on the one hand, unaware of the legal requirements established by the City Statute and the respective municipal legislations. On the other hand, he does not perceive the bad use he makes of his property, because there is an information gap on the part of the municipal administration in relation to urban property owners. If every urban property owner in Sobradinho had access to information about his duty as a property owner, perhaps not so much retention and speculation of properties without observing the social function of the property would occur, although it is also observed that this also occurs due to the speculative dynamics of the real estate market. The main objective of this work is to analyze the implementation of the instruments and institutes suggested by the City Statute, which aim to fulfill the social function of urban real estate property in the municipality of Sobradinho, in the Vale do Rio Pardo region. The existence of properties located in the central area whose current land uses show evidence of non-compliance with the social function of property motivates us to seek to understand how the municipal administration perceives and acts in relation to this situation. There is a lack of studies related to the theme in small cities in Brazil, even in a federative context in which most cities are small, and political, individual and private interests prevail over the social interest. In methodological terms, this work is characterized as an exploratory research of a qualitative-descriptive nature, based on a case study. The results of the research make evident the need to reformulate the Master Plan of this city, in order to better contemplate the use of the instruments of the City Statute that seek to ensure the effectiveness of the social function of property in the municipality. Some property owners, because they have better economic conditions, or because they seek to increase the value of their properties, ignoring the municipal legislation, end up not using their properties properly, or even not selling them. Thus, they do not fulfill the social function of the property in Sobradinho. There is an urgent need to inform society about the social function and its fulfillment, in order to make the population more aware of the importance of implementing it. The fact that we have not had any return on the information filed with the municipal government shows, for us researchers, that the issue of planning and the effectiveness of the City Statute in Sobradinho presents problems and contradictions. In view of the analysis of the case of the city of Sobradinho, we can see the importance of ensuring the collective interests in relation to the way the current uses of the soil in the city occur, and the effectiveness of the social function of the urban properties located in its central area. The fulfillment of this function aims to guarantee access to urban land and to the rights that the city offers, also in the case of small cities.pt_BR

dc.description.resumoNeste trabalho, analisamos o cumprimento da função social da propriedade em cidades pequenas da Região do Vale do Rio Pardo, mais especificamente, o caso da cidade de Sobradinho - RS. A temática da função social da propriedade urbana e de seu cumprimento, bem como a necessidade do estabelecimento de uma maior regulação e fiscalização pelo poder público municipal, tem sido amplamente analisada no contexto das grandes e médias cidades, onde a dinâmica da urbanização tem sido mais intensa. Nas pequenas cidades, essa temática ainda tem sido pouco analisada e debatida no País. Nessas cidades, é comum que, os proprietários e inclusive os gestores público, não tem conhecimento das exigências legais estabelecidas pelo Estatuto da Cidade e pelas respectivas legislações municipais. Por outro lado, o proprietário não percebe o mau uso que faz do seu imóvel, pois existe uma lacuna informacional por parte da administração municipal em relação aos proprietários de imóveis urbanos. Se todo proprietário de imóvel urbano em Sobradinho tivesse acesso à informação quanto ao seu dever como proprietário, talvez não ocorresse tanta retenção e especulação de imóveis sem observar a função social da propriedade, muito embora se observe também que isso igualmente ocorre em razão da dinâmica especulativa do mercado imobiliário. O objetivo principal deste trabalho é analisar como se dá a implementação dos instrumentos e institutos sugeridos pelo Estatuto da Cidade, que objetivam o cumprimento da função social da propriedade imobiliária urbana no Município de Sobradinho, na região do Vale do Rio Pardo. A existência de imóveis localizados na área central cujos usos atuais do solo evidenciam o não cumprimento da função social da propriedade, motiva-nos a buscar entender como a administração municipal percebe e atua em relação a essa situação. Há uma carência de estudos relacionados ao tema em cidades pequenas do Brasil, mesmo num contexto federativo em que a maioria das cidades é de pequeno porte, e os interesses políticos, individuais e particulares se sobressaem perante o interesse social. Em termos metodológicos, este trabalho caracteriza-se como uma pesquisa exploratória de natureza qualitativa-descritiva, baseada em estudo de caso. Os resultados da pesquisa deixam evidente a necessidade de reformulação do Plano Diretor dessa cidade, de modo a melhor contemplar o uso dos instrumentos do Estatuto da Cidade que buscam assegurar a efetivação da função social da propriedade no Município. Alguns proprietários, por possuírem melhor condição econômica, ou por buscarem uma maior valorização dos imóveis, ignorando a legislação municipal, acabam não dando um uso adequado, ou mesmo, não comercializando seus imóveis. Concretizam, assim, o não cumprimento da função social da propriedade em Sobradinho. Existe urgência em levar informações à sociedade sobre a função social e o seu cumprimento, de modo a melhor conscientizar a população sobre a importância de implementá-la. O fato de não termos tido retorno das informações protocoladas na prefeitura municipal evidencia, para nós pesquisadores, que a questão do planejamento e da efetividade do Estatuto da Cidade em Sobradinho apresenta problemas e contradições. Diante da análise do caso da cidade de Sobradinho, verifica-se a importância de se assegurar os interesses coletivos em relação ao modo como ocorrem os atuais usos do solo na cidade, e a efetivação da função social das propriedades urbanas localizadas em sua área central. O cumprimento dessa função tem como objetivo garantir o acesso à terra urbana e aos direitos que a cidade oferece, também no caso das pequenas cidades.pt_BR
