Resumo: | Este trabalho de conclusão de curso traz uma reflexão sobre a possibilidade da Educação Jurídica no Ensino regular, a fim de reunir temas importantes e conhecimentos que os alunos podem receber no âmbito jurídico. Tem seu maior foco em relação a possibilidade de evoluir como membros ativos na sociedade, se tornarnando relugadores e fiscais dos direitos já conquistados perante a tragetória. Traz se o contexto da educação e um relato histórico, como foi um processo evolucional para a humanidade aprender e evoluir perante especies dominantes. Trazendo para os dias atuais, onde se tem uma sociedade que precisa evoluir para se tornar parte ativa da comunidade. Identifica-se o direito à educação como fator, essencial e indispensável a tomada de consciência do indivíduo sobre sua posição social e seu desenvolvimento para o exercício da cidadania. A pesquisa visa, também, estabelecer um diálogo entre a disciplina jurídica, que acredita-se ser de grande relevância para esse exercício e a pedagogia como área da educação que pensa o fazer educativo. Sendo assim, ao final da pesquisa verificou-se como resultado que, no processo de formação escolar, os alunos recebem pouca orientação sobre o funcionamento do sistema judiciário em que estão inseridos, concluindo-se que a educação jurídica ainda se mostra apenas num ideal. |
Resumo em outro idioma: | This work has as main objective the legal education at Schools and its repercussions in improvement of citizenship and therefore of the social, labor and political entity. Given the complexity of the subject and, as well, the range of the subject in front of Brazilian Society, it is necessary to delimit the study in some aspects, separating the historical and practice context. At first, as it is a constitutional issue, it is restricted to the legislative question of the Constitution of the Federative Republic of Brazil, as well as special laws related to Education and, in addition, the place is limited to the Brazilian territory, because it is a social issue, but without giving up of examples that worked in other countries. Another placement, in order to understand the concept of the right to education, even though it is implicit in the legislation that´s everone right and, given thats it is directly linked to social rights and, finally, the 21st century as the last delimitation referring to the temporal elapsing where the study brings out the impact on society and it is been considering that it reflects on current issue and evolution of the democratic State like Brazil. In this scope, some hypotheses can be deduced that’ll help in the reflection of a proposed solution. First, it is clear that the exercise of citizenship exists fto materialize the individual, social, collective and diffuse rights, where the Society has the duty to fulfill and pass on legal education in schools to its equals. For this, not applying legal education in Schools represents the limitation of the exercise of the community, hence having omission that brings injustice. In a country where individual and social rights are repeatedly and laxly suppressed, there is no doubt that there is a lack of specifically constitutional content in the mandatory national education grid, because assists to collaborate the incapacity suffered by the population to request and demand political actions, culminating in a social withdrawal on a part of the public power. Conversely, always exist other school subjects that indirectly deal with law and citizenship that are being aplied, however, are superficially transmitted, perhaps due to the lack of specific training of teachers - that although having good intentions-, they do not reach the complexity and effectiveness of the content, therefor, it is been limiting the ability of students to learn about a fundamental issue and to practice and consolidate rights and citizenship. Finally, it is necessary to implement legal education in schools to instruct the formation of citizens who are aware of their rights and duties, in face of the social body which is consolidated in the exercise of citizenship. The inclusion of legal education in the curriculum of elementary and high school education, makes students holders of general and daily knowledge, enabling the formation of students in society, giving them tools to criticize, reflect and build a democratic state of rights, which is guarantee of freedom, justice and equality in between individuals. In order to achieve the objectives proposed here, it’ll be explained the methodological aspect, method of approach, method of procedure, research regarding the general objective, research regarding the technical procedure and the research technique. In that regard and in consideration of the flagrant mitigation of the current citizenship exercise in the country, it is necessary to implement legal education in schools in order to provide a setting of comprehensive and evolving knowledge of fundamental rights and duties to form a citizen. Therefore, it is expected to present relevant strategies for the solution of this social problem, introducing the course of legal education in schools and in the lives of today's students who will be improving to social life, for the improvement of tomorrow's citizens. |
