dc.description.abstractThis study seeks to outline systemic guidelines for the design of public policies that can be applied to the State of Rio Grande do Sul considering the current fiscal situation. The analysis of the theme is treated in a case study based on the analysis of the fiscal situation of the State of Rio Grande do Sul. The general objective is to answer the following question: What are the guidelines for, in the light of the systemic theory and based on risk management of the fiscal situation of the State of Rio Grande do Sul, formulating the design of public policies? From the problem, the hypothesis is established whether it is possible to infer, from Niklas Luhmann's Theory of Systems, guidelines for public policies that minimize future damages in the public finances of the State of Rio Grande do Sul. Within the general objective of establishing guidelines, from the systemic matrix for the observation and design of public policies tending to the improvement of the fiscal situation of the State of Rio Grande do Sul, the text deals with the specific objectives of observing, from the theory of the systems, the Rio Grande do Sul organization, in order to establish assumptions about how the Federation and the State of Rio Grande do Sul can be observed as organizations from the political and legal system; to observe public policies and their relationship with budgetary/financial decisions; from the systemic theory, to consider the fiscal situation of Rio Grande Sul, relating to the previous categories, pointing out the main decisions in fiscal policy that led to unsustainability and insufficiency in other public policies; and diagnosing the bottlenecks and main risks, such as expenses that cannot be reduced, and situations in which there is no possibility of decision, the “non decidable” (or undecidable) sphere. The method is the hypothetical-deductive approach as the main one, using the case study, with systemic analysis, from concepts of politics, economics, sociology and systems theory. The research technique is bibliographical and, procedurally, the method will be functionalist and historical. Within the purposeful character of the Graduate Program in Law at the University of Santa Cruz do Sul - UNISC, the thesis is spatially limited to the State of Rio Grande do Sul.pt_BR

dc.description.resumoO presente estudo busca traçar diretrizes sistêmicas para o desenho de políticas públicas que possam ser aplicadas ao Estado do Rio Grande do Sul considerada a atual situação fiscal. A análise do tema é tratada em estudo de caso a partir da análise da situação fiscal do Estado do Rio Grande do Sul. O objetivo geral é responder ao seguinte questionamento: Quais são as diretrizes para, à luz da teoria sistêmica e a partir de uma gestão de riscos da situação fiscal do Estado do Rio Grande do Sul, formular o desenho de políticas públicas? A partir do problema é estabelecida a hipótese se é possível inferir, da Teoria dos Sistemas de Niklas Luhmann, diretrizes de políticas públicas que minimizem danos futuros nas finanças públicas do Estado do Rio Grande do Sul. Dentro do objetivo geral de estabelecer diretrizes, a partir da matriz sistêmica para a observação e concepção de desenho de políticas públicas tendentes à melhoria da situação fiscal do Estado do Rio Grande do Sul, o texto trata dos objetivos específicos de observar, a partir da teoria dos sistemas, a organização Rio Grande do Sul, de forma a estabelecer premissas sobre como a Federação e o Estado do Rio Grande do Sul podem ser observados como organizações a partir do sistema político e jurídico; de observar as políticas públicas e a sua relação com decisão orçamentária/financeira; de a partir da teoria sistêmica, considerar a situação fiscal do Rio Grande Sul, relacionando com as categorias anteriores, apontando as principais decisões na política fiscal que levaram à insustentabilidade e insuficiência nas demais políticas públicas; e de diagnosticar os gargalos e principais riscos, como despesas que não podem ser diminuídas, e situações nas quais não há possibilidade de decisão, a esfera do "não decidível" (ou indecidível). O método é a abordagem hipotética dedutiva como principal, utilizado o estudo de caso, com análise sistêmica, a partir de conceitos da política, da economia, da sociologia e da teoria dos sistemas. A técnica de pesquisa é a bibliográfica e, procedimentalmente o método será funcionalista e histórico. Dentro do caráter propositivo do Programa de Pós-Graduação em Direito da Universidade de Santa Cruz do Sul - UNISC a tese espacialmente é limitada ao Estado do Rio Grande do Sul.pt_BR
