Abstract

The present work focuses on the effectiveness of coercive measures in the fulfillment of alimentary obligations in cases of economic insufficiency and aims to analyze the effectiveness of coercive measures in the collection of alimentary debt, when the financial vulnerability of the debtor and the creditor is verified. In these terms, it is questioned whether the coercive measures against the alimentary debtor are truly effective. The method of approach used is deductive, starting from a general analysis to the particular, until the conclusion of the research. The study of the topic is of fundamental importance, as coercive measures are impaired when applied to the insufficiently alimenting party, requiring the promotion of policies that mitigate the economic vulnerability of those involved by the State and civil society, as well as a multifaceted approach to ensure the enforcement of alimentary rights and the protection of the fundamental rights of the parties involved.
