Abandono afetivo nas relações familiares : a responsabilização civil sob a perspectiva da jurisprudência.

Abstract

This research deals with emotional abandonment in family relationships. The general objective is to study the concept of family, its historical context, as well as the types of custody in the legal system, in order to understand that emotional abandonment is present in family relationships, with children and adolescents being the individuals who suffer the impact of this conduct. Furthermore, check if there is a way to alleviate the conduct of the parent who decides to withdraw from their child's life, in this sense, check if the appropriate way would be to hold that parent civilly liable. The specific objectives are: to study the concept of family, its historical construction over the years until today; compare custody arrangements and their influence on family relationships; and, analyze the civil liability of the person causing the emotional abandonment. The deductive approach method, the monographic procedure method and bibliographic research techniques were used. To support the research, the question was: is it possible to hold the parent responsible for the emotional abandonment of a child? What is the jurisprudential understanding on this matter? It is of great importance to study the topic since emotional abandonment directly affects family relationships, especially the development of children and adolescents in different areas of life.
