| Título: | O direito de propriedade imobiliária no ordenamento jurídico brasileiro : direito público ou privado? |

| Resumo: | A presente monografia possui como foco tratar do direito de propriedade de bem imóvel no ordenamento jurídico brasileiro. Verifica-se o atual viés interpretativo da propriedade de bem imóvel no direito brasileiro, se manteve a sua interpretação privada ou se, em razão da sua função social, assumiu um viés público. Ainda, com objetivos específicos de estudar a história da propriedade imobiliária como instituto jurídico, verificar a proteção constitucional e infra constitucional da propriedade imobiliária no Direito Brasileiro e por fim, analisar a função social da propriedade imobiliária no Direito Brasileiro. Este trabalho foi dividido da seguinte forma: o primeiro capítulo aborda o direito de propriedade como instituto jurídico, por meio da definição e breve contextualização histórica, o segundo faz referência do direito de propriedade sob a ótica do ordenamento jurídico pátrio inaugurado pela constituição de 1988 e o terceiro, e último capítulo pretende-se apresentar a função social da propriedade imobiliária no direito brasileiro, quais os instrumentos jurídicos de implementação e analisar as jurisprudências do Supremo Tribunal Federal, cabe frisar que para a análise jurisprudencial, foram selecionadas cinco decisões dos Tribunais Superiores: ADI nº 2.213 MC/DF, AgInt na ACO nº 1.602/PE, RE nº 1.521.864/SP, RE nº 1.499.300/MG e ADI nº 5.547/DF. A seleção considerou julgados que abordam o direito de propriedade sob a perspectiva da função social, ainda que alguns não sejam recentes, apresentam relevante entendimento consolidado sobre a matéria. As decisões analisadas contribuem para reafirmar que o direito de propriedade não possui caráter absoluto, devendo atender aos princípios constitucionais e à sua função social. Por isso, se analisa: A propriedade de bem imóvel no direito brasileiro, em razão da sua função social, manteve seu viés privativo ou assumiu um caráter público? O método adotado para a realização do Trabalho de Curso é o método hipotético dedutivo, onde partindo-se de uma tese geral a respeito da natureza jurídica do instituto jurídico da propriedade imobiliária, e a partir de hipóteses levantadas, muito especialmente em razão do viés social atrelado ao seu conteúdo e conceito, buscar se-á verificar a atual natureza jurídico deste importante instituto jurídico. É de fundamental relevância o estudo do tema, tendo em vista que o Direito de Propriedade é o principal instituto jurídico do direito privado brasileiro e, considerando que a função social da propriedade imobiliária está integrada ao seu conteúdo e ao próprio conceito, há necessidade de se verificar como o direito pátrio, atualmente, tem regulado a propriedade imobiliária e se esta manteve a sua natureza privada ou assumiu um viés público. A partir do trabalho realizado, concluiu-se que a propriedade imobiliária, no direito brasileiro, mantém sua essência privada, contudo submetida a atender a função social, condicionando o exercício da utilização da propriedade pelo proprietário aos interesses da coletividade. Todavia, em decorrência da Constituição de 1988, o direito de propriedade não possui mais natureza absoluta, passando a sofrer limitações impostos pelo interesse público, e pela necessidade de cumprir a função social da propriedade. |
| Resumo em outro idioma: | This monograph focuses on the right to real property within the Brazilian legal system. It examines the current interpretive approach to real property in Brazilian law, determining whether its interpretation has remained private or, due to its social function, has taken on a public character. Furthermore, the specific objectives of this study are to examine the history of real property as a legal institution, to assess the constitutional and infra-constitutional protection of real property under Brazilian law, and, finally, to analyze the social function of real property in Brazilian law. This work is organized as follows: the first chapter addresses the right to property as a legal institution, through its definition and a brief historical context; the second chapter examines the right to property from the perspective of the Brazilian legal system established by the 1988 Constitution; and the third and final chapter aims to present the social function of real property in Brazilian law, identify the legal instruments for its implementation, and analyze the case law of the Federal Supreme Court; It should be noted that for the case law analysis, five decisions from the higher courts were selected: ADI No. 2,213 MC/DF, AgInt in ACO No. 1,602/PE, RE No. 1,521,864/SP, RE No. 1,499,300/MG, and ADI No. 5,547/DF. This selection includes court decisions that address property rights from the perspective of their social function; although some are not recent, they present a relevant and well-established understanding of the subject. The decisions analyzed help reaffirm that the right to property is not absolute and must comply with constitutional principles and its social function. Therefore, the following question is examined: Has real property ownership in Brazilian law, due to its social function, retained its private character or taken on a public character? The method adopted for this course paper is the hypothetical-deductive method, in which, starting from a general thesis regarding the legal nature of the legal institution of real property, and based on hypotheses raised—particularly in light of the social aspect linked to its content and concept—we will seek to verify the current legal nature of this important legal institution. The study of this topic is of fundamental importance, given that property law is the primary legal institution of Brazilian private law; and, considering that the social function of real property is integral to its substance and very concept, it is necessary to examine how Brazilian law currently regulates real property and whether it has retained its private nature or taken on a public character. Based on this study, it was concluded that real property, under Brazilian law, retains its private essence, though it is subject to fulfilling a social function, thereby conditioning the owner’s exercise of the right to use the property to the interests of the community. However, as a result of the 1988 Constitution, the right to property is no longer absolute in nature; it is now subject to limitations imposed by the public interest and by the need to fulfill the social function of property. |
