dc.description.abstractThis monographic work has as its theme the limits of parliamentary immunity, especially between the defense of democracy and the abuse of prerogatives, and aims to analyze whether this constitutional guarantee has been used abusively and in disagreement with the Federal Constitution, as well as to verify the role of the Federal Supreme Court in controlling such excesses. In this context, the problem to be addressed consists of understanding the constitutional limit between the functional protection ensured by parliamentary immunity, provided for in article 53 of the Federal Constitution of 1988, and the abuse of this prerogative, considering the role of the Federal Supreme Court within the system of checks and balances. To accomplish this task, the deductive method is used, through bibliographic and documentary research, with analysis of legal doctrine, scientific articles, constitutional texts, legislative proposals and decisions of the Federal Supreme Court. Finally, it can be stated that parliamentary immunity has a functional and institutional nature, and must be preserved when linked to the exercise of the mandate and democratic representation, but may be limited when used as an instrument of impunity, personal attack or institutional rupture, without allowing judicial control to become political control over parliamentary speech.pt_BR

dc.description.resumoO presente trabalho monográfico possui como tema os limites da imunidade parlamentar, especialmente entre a defesa da democracia e o abuso de prerrogativas, e tem como objetivo analisar se essa garantia constitucional vem sendo utilizada de forma abusiva e em descompasso com a Constituição Federal, bem como verificar a atuação do Supremo Tribunal Federal no controle desses excessos. Nesse contexto, a problemática a ser enfrentada consiste em compreender qual é o limite constitucional entre a proteção funcional assegurada pela imunidade parlamentar prevista no art. 53 da Constituição Federal de 1988 e o abuso da prerrogativa, considerando o papel do Supremo Tribunal Federal no sistema de freios e contrapesos. Para dar conta dessa tarefa, utiliza-se o método dedutivo, por meio de pesquisa bibliográfica e documental, com análise de doutrina, artigos científicos, textos constitucionais, propostas legislativas e julgados do Supremo Tribunal Federal. Por fim, pode-se afirmar que a imunidade parlamentar possui natureza funcional e institucional, devendo ser preservada quando vinculada ao exercício do mandato e à representação democrática, mas podendo ser limitada quando utilizada como instrumento de impunidade, ataque pessoal ou ruptura institucional, sem que o controle jurisdicional se transforme em controle político da palavra parlamentar.pt_BR
