| Resumo: | O presente trabalho monográfico investiga a hermenêutica sob a égide do Estado Democrático de Direito, tendo como tema central o papel da interpretação na concretização da normativa constitucional. O objetivo geral consiste em analisar a hermenêutica como instrumento indispensável para assegurar a supremacia da Constituição e a efetividade dos direitos fundamentais, propondo a superação dos modelos clássicos e positivistas de ensino e aplicação do Direito. A problemática central reside na tensão dialética entre a necessidade de uma interpretação jurídica pautada pela integridade e coerência do ordenamento e os riscos inerentes ao decisionismo judicial, fenômeno em que o subjetivismo e a discricionariedade do magistrado ameaçam a segurança jurídica. Para o desenvolvimento desta pesquisa, adota-se uma metodologia de análise hermenêutica multidimensional e interdisciplinar, que perpassa os métodos gramatical, sistemático, histórico e teleológico, integrando-os às contribuições da filosofia da linguagem e da sociologia jurídica. Os resultados apontam que a consolidação democrática e a proteção das garantias fundamentais são indissociáveis da qualidade da atividade interpretativa. Conclui-se, portanto, que a hermenêutica deve ser operada como um compromisso ético-político com o texto constitucional, exigindo um rigor argumentativo que afaste o senso comum teórico e promova um Direito efetivamente conectado às transformações e exigências da realidade social contemporânea. |
| Resumo em outro idioma: | The present monographic work investigates hermeneutics under the aegis of the Democratic State of Law, focusing on the role of interpretation in the realization of constitutional norms. The general objective is to analyze hermeneutics as na indispensable instrument to ensure the supremacy of the Constitution and the effectiveness of fundamental rights, proposing the overcoming of classical and positivist models of legal education and application. The central problem lies in the dialectical tension between the need for a legal interpretation guided by the integrity and coherence of the legal system and the risks inherent in judicial decisionism—a phenomenon where the magistrate's subjectivism and discretion threaten legal certainty. To develop this research, a multidimensional and interdisciplinar hermeneutic analysis methodology is adopted, which encompasses grammatical, systematic, historical, and teleological methods, integrating them with contributions from the philosophy of language and legal sociology. The results indicate that democratic consolidation and the protection of fundamental guarantees are inseparable from the quality of the interpretive activity. It is concluded, therefore, that hermeneutics must be operated as an ethical-political commitment to the constitutional text, requiring an argumentative rigor that moves away from theoretical common sense and promotes a Law effectively connected to the transformations and demands of contemporary social reality. |
